Terms and Conditions for Clients

General

Once a tutoring position has been confirmed, you enter into a contract between you (either as the student or as the student’s parent/guardian) and the tutor. For the avoidance of doubt, each tutor registered with USApplicants is self-employed or on a casual work contract, and USApplicants acts solely as an agent for the tutor.

USApplicants reserves the right to alter these terms and conditions. We will, however, notify you in writing of any changes.

No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by a Director of USApplicants.

Unless otherwise agreed in writing by a Director of USApplicants, these Terms and Conditions shall prevail over any other terms of business or conditions put forward by you.

Environment

You are responsible for finding a suitable environment in which tuition can take place. The suitability of such an environment remains at the absolute discretion of USApplicants at all times.

Payment

Your tutor keeps a timesheet. This does not need to be signed by you but we suggest you keep your own record of tuition dates and times. The tutor submits the timesheet to USApplicants at the end of each calendar month, and may ask you to sign off on it.

You don’t pay the tutor directly. USApplicants sends you an invoice on behalf of and as an agent for the tutor. The tutor will not receive his or her fee until we receive payment from you.

We request that invoices are paid on presentation, and in all cases, no later than 10 days after presentation. You may pay your invoice by cheque or direct bank transfer. Should you have any queries arising from the invoice, they must be brought to the attention of USApplicants within 7 days.

In case of non-payment within 10 days of the issuance of an invoice, USApplicants will contact the client with invoice reminders. If the invoice remains unpaid 30 days after issuance, USApplicants will cease any ongoing tuition. Thereafter, USApplicants will initiate a procedure to bring a case to the Small Claims Court.

For USApplicants students who are paying for their own lessons in the absence of a guarantor, we will invoice you once you decide to go forward with booking multiple hours; we ask for this invoice to be paid before subsequent lessons are delivered.

Cancellation policy

For hourly placements, please ensure that you and the tutor are agreed on the arrangements for each lesson. If you need to cancel or change a lesson, please call the tutor directly, though of course, feel free to call USApplicants also. Tutorials that are cancelled by the client with less than 24 hours’ notice are charged for in full.

For residential placements, please ensure that you and your tutor are agreed on the arrangements for each position. Positions that are cancelled by the client with less than 14 days’ notice are charged for in full.

Both the client and the tutor must give reasonable notice of any holiday commitments they may have, and any changes to the tuition timetable necessary because of illness. An alternative date will be arranged.

Where tuition is not agreed for a specific period, please give at least seven days’ notice of the end of tuition in writing to both your tutor and to USApplicants so that your tutor may conclude his or her work with the student and plan his or her commitments.

Guarantee

We cannot guarantee the performance of a tutor. If a client has a complaint against the tutor or against USApplicants, we regard it as a point of contract that we are informed within 24 hours of the occurrence that gave rise to the objection.

USApplicants supplies each tutor in good faith and in the belief that he or she will perform to the best of his or her abilities. However, we cannot guarantee the performance of the tutor. USApplicants will not be liable to the client or any third party for any act, omission or error (whether wilful, negligent or otherwise) of the tutor.

Any opinion expressed by the tutor is not necessarily an expression of the opinion of USApplicants.

Private Arrangements

Clients are not permitted to make private arrangements for tuition with tutors introduced by USApplicants. By confirming a tutoring position, you undertake not to make any such arrangements with any tutor registered with USApplicants.

Damages

USApplicants cannot be held liable for any damages caused by any tutor provided by us during tuition.

Responsibilities

A tutor cannot be held responsible for chaperoning minors, nor guarding a house and household effects while tutoring. Please ensure that a responsible adult is on the premises at all times.

Data Protection Act

USApplicants uses client data for the purposes of the services that it provides. Clients providing personal data consent to the use of that data by USApplicants for the purpose of effecting introductions to tutors, for billing and fee collecting purposes and to enable USApplicants to contact the client from time to time.

Jurisdiction

These terms and any non-contractual obligations arising out of or in connection with them shall be governed by English law and the parties hereby submit to the exclusive jurisdiction of the English Courts.
